Terms and Conditions

In these T&C "We", "Our", "Us", "Company", "Positive Day Tour" refer to "Positive Day Tour" limited liability company, which was founded and is currently operating in accordance with the legislation of the Republic of Armenia, and "You", "Your", "Yours", "Customer" refer to the person, who has logged into this website, applies for and/or uses the services of the Company.

By accessing, viewing and using the Website, any service of the Website or downloading any content, You hereby confirm that You have thoroughly read these T&C and unconditionally accept them, whether You are a user of the Company services, a registered user of the Website, Customer, or simply a visitor.

The Company is entitled to unilaterally change these T&C any time, without any prior notice. Each change made (with a respective date) is published on the Website. It is Your responsibility to visit the Website from time to time in order to check T&C amendments and/or additions. The new T&C will have legal force and will be applicable to the relations and responsibilities that have arisen before publishing it on the Website.

The Website may contain errors, inaccuracies and omissions, implying services, their price and content. The Company has the right to correct the errors at any time, including those that are related to already confirmed orders. In this case, upon possibility, the Company will offer You to keep the already confirmed and corrected order, or to cancel it.

If You do not accept these T&C, please, stop any use of the Website. Being on the Website, opening an account, becoming a Customer and using the services are proof of Your unconditional acceptance of these T&C.

The Prices on the Website are presented in the national currency of the Republic of Armenia – Dram of RA (AMD), as well as in several other currencies. Prices in other currencies have solely informative nature and can be used for guidance purposes only. The convertible Prices of other currencies are calculated on the basis of the average exchange rate offered by Armenian banks. These Prices are frequently updated; however, the currency converter should not be absolutely relied on as an accurate real-time calculator. Actual currencies may vary.

The Prices of the Services may be changed without notifying you in advance. We have the right to change any announced Price and correct any error, inaccuracy or omission, regardless of the circumstance whether the Order of the Service has been confirmed, a payment from Your bank card has been made or not. Moreover, if a payment from Your bank card has been made, and if We cancel Your Order, then We are obliged to transfer the withdrawn amount back onto Your bank card. The money transfer duration depends on banking and/or payment systems.

As the tour package is based on overnight services, the package cancellation policy will be settled in accordance to the hotel reservation policy. The company is obliged to notify you about the cancellation terms while making bookings.
By booking your arrangement with us or using our website, you are agreeing to be bound by the terms of this Agreement, including any additional terms and conditions of any Supplier that are applicable to your booking, travel arrangements or use of any website content. You agree on behalf of yourself and those you represent to comply with all such terms and conditions, including the payment of all amounts when due.

The Price on the Group Tour ticket presents the Price of the Tour for 1 person. The Group Tour ticket is valid for the date mentioned on the ticket only.

The average duration for each destination is mentioned on the Website as well as on the ticket; however, the Tour may actually take up to 10% more or less of that time.

Age discounts may apply to Group Tours, if the Customer provides age proof document.

The preferred seats inside the vehicle are not reserved in advance.

Citizens of certain countries must obtain a visa in order to travel to Georgia, and in some cases, they may need a return visa for Armenia as well. The Company does not have visa provision or support services. The Company can only inform the participant about the need for a visa. Visas are issued on the basis of existing international agreements between the Republic of Georgia and/or Republic of Armenia and the country of Your citizenship.

During Tours it is advisable to wear comfortable shoes, preferably closed.

Regardless of the destination, it is preferable to take warm clothes as well, since the climate in the sites may differ from the climate in Yerevan.

When visiting churches, men and women are advised not to wear open clothes. For women, a scarf is desirable.

The Company is not responsible for any of Your items left, lost, damaged or destructed in the vehicles and in the sites during Tours.

In case of certain Tours, depending on the destination and location, the transportation means may be unable to reach the destination, and the participants may need to walk some distance and/or climb some stairs. If the participants have difficulties walking or overcoming stairs, then they should verify in advance if destinations include such sites.

Apart from the stops listed in the itinerary of Group Tours, there may be additional stops with the consent of all the participants of the group.

The presented Prices of Private Tours are calculated taking into account that the Tours start from and end in Yerevan. In case of starting the Tour from and/or ending it in a different place, there may be recalculation and change in Price.

During Private Tours there can be additional stops and site visits only in case of real possibility. Should there be significant detours, and should the Tour take longer than the scheduled time, the Company performs recalculation, which may result in the necessity of additional charge.

In the scope of Meal Provision Service Booking, based on the data provided by the Customer, on their behalf, at their expense and by their assignment, the Company realizes meal provision booking in restaurants, hotels, halls and other venues.

When booking, the Company acts exclusively as an agent between You and the company providing meal services. The Company itself does not provide meal services.

The Company is not responsible for any incomplete or inappropriate service provision by the meal providing company, as well as for their unscrupulous behavior, mistakes, omissions, negligence, for any of Your complaints regarding the meal provision services, and for any direct and indirect damage or expense that You may incur as a result.

The Company is not responsible for any of Your items left, lost, damaged or dеstructed in the meal provision places.

In case of Order cancellation the Deposit is not refunded to the Customer.

If the Customer has not paid for the Group Tour ticket at least 24 hours prior to the Tour departure time, then the Company has the right to cancel the Tour reservation without warning.

If a Customer with an already purchased ticket refuses to participate in the Tour informing the Company about it at least 24 hours in advance, then the whole amount of the ticket cost is refunded, and if the Customer refuses the participation later than the above-mentioned period, no amount is refunded.

Due to unfavorable weather conditions or force majeure state, and for security reasons, the Company has the right to change, shorten or cancel the given Tour. In such cases the whole amount paid for the ticket is returned to the Customer.

If the Company has replaced the sites or services provided within the Tour with equivalent sites or services due to the above-mentioned circumstances, then it has no obligation towards the Customer and does not have to refund any amount of money. In case of non-equivalent replacement, the Company refunds the Customer the Price difference between the purchased Tour and the Tour that has actually taken place.

The Deposit for Tour Package Services makes up 30% of the total Price. The Order cannot be confirmed without Deposit. Payment of the balance for the Tour Package is made up to 72 hours before the start of the order.

In specific cases, the terms and conditions of Deposit and Balance Payment, cancellation and change within a Tour Package are discussed and agreed by the Company and the Customer, based on the given Order.

The published Reviews express the opinions of different individuals and have solely informative and guiding nature, and may not match with Your personal ideas, opinions or expectations.

For Your Order to be fulfilled properly, You have to use the correct email address of Yours and to provide accurate Communication Means. We bear no responsibility for any incorrect or incomplete Communication Means provided by You and are not obliged to verify their authenticity.

Once the Company sends a notification to the email address(es) that You have provided, that notification is considered received by You via email.

The Company bears responsibility neither for any actions, errors, mistakes, claims, guarantees, negligences of other companies presented on the Website, nor for any physical damage, death, material or other damages and expenses incurred as a result of their actions.

The Company bears no responsibility for any misunderstanding resulted from misreading, inattentive reading of any information published on the Website, or other similar circumstances.

This Agreement shall be governed by the laws of the Republic of Armenia. If any provision of this Agreement is found to be invalid, illegal or unenforceable, the enforce-ability of the remaining provisions will not in any way be affected or impaired.
